Glick: Bill targeting Indiana's carbon dioxide sequestration laws passes House

STATEHOUSE (March 25, 2025) — A bill authored by State Sen. Sue Glick (R-LaGrange) that would clean up Indiana's carbon dioxide sequestration laws recently passed the House of Representatives by a vote of 55 to 37.

Senate Enrolled Act 457 would clean up Indiana's laws on carbon dioxide sequestration by addressing the following issues.

  • SEA 457 contemplates where a pipeline is across a wholly owned and contained property owner or conglomerate of owners. In this circumstance, a second permit is not needed.
  • The bill would move the fee revenue collected for the permits to the State General Fund, provide that a filing fee for the permit for a project should be deposited in the State General Fund and adjust the filing fee for carbon sequestration permits.
  • It would require storage operators to pay the Department of Natural Resources (DNR) a fee of eight cents per metric ton of carbon dioxide injected into a storage facility for the previous calendar year, direct the DNR to establish and issue permits allowing a person to drill and operate a carbon dioxide investigatory well or convert an oil or gas well for use in a carbon dioxide investigation, and describe circumstances in which the DNR may inspect and maintain wells or storage facilities.
  • The bill would expire the carbon dioxide storage facility trust fund and provide for the transfer of money from the fund into the State General Fund.
  • SEA 457 would establish civil penalties for statutory violations.

"Protecting our state's natural resources is one of my top legislative priorities. SEA 457 addresses concerns brought to me by industry professionals who face challenges due to the lack of order among some of the state's carbon dioxide sequestration laws," Glick said. "The bill retargets where permit fees and storage fees go after being paid to the DNR and directs the DNR to establish a permit to allow an individual to drill and operate a carbon dioxide investigatory well. Additionally, we're giving DNR guidance on when and how the agency can perform inspections on existing operations."

SEA 457 will now move to the governor's desk for further consideration.
