Alting: Probable cause affidavit transparency bill unanimously passes Senate

STATEHOUSE (Feb. 10, 2025)A bill authored by State Sen. Ron Alting (R-Lafayette) that would improve law enforcement transparency unanimously passed the Senate today.

Senate Bill 259 would require law enforcement officers to disclose in a probable cause affidavit any kind of conflict of interest that officer may have in the case.

With SB 259, local prosecutors would have more information when they review probable cause affidavits.

Alting said he filed the bill after becoming aware of a situation that occurred in Tippecanoe County in which a local police officer's family member made criminal accusations against another individual.

"Everybody deserves to be treated fairly and equally in the eyes of the law," Alting said. "SB 259 adds a layer of transparency to probable cause affidavits by ensuring any personal interests are disclosed by the officer filling out the paperwork."

The bill now moves to the House of Representatives for further consideration.
